Probate

ˈproʊbeɪt ‎ / ‎ PRO-bayt

Probate is the legal process through which a deceased person’s will is formally recognised by the court, allowing the executor to administer the estate according to Irish succession law.

Origin

From Latin probare, meaning “to prove” or “to test.”

Definition

Probate is the legal process through which a deceased person’s will is formally recognised and administered.

In Ireland, the Probate Office issues a “Grant of Probate” to the executor named in the will, allowing them to collect assets, pay debts, and distribute the estate according to the deceased’s wishes.

If there is no valid will, different legal procedures apply under intestacy law.
